Refunds for canceled orders are subject to our Refund Policy.

  • OUR SERVICES WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION
  • ANY ERRORS OR DEFECTS WILL BE CORRECTED
  • OUR SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • THE RESULTS OF USING OUR SERVICES WILL MEET YOUR REQUIREMENTS

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRESHSLICE PIZZA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, OUR SERVICES.

IN NO EVENT WILL OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO FRESHSLICE PIZZA IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE.

6.3 Exclusions

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless Freshslice Pizza, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your User Content
  • Your use of our Services
  • Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right

8. Dispute Resolution

These Terms and your use of our Services shall be governed by and construed in accordance with the laws of Canada, without giving effect to any choice or conflict of law provision or rule.

8.2 Informal Dispute Resolution

If you have any concerns or disputes about our Services, you agree to first try to resolve the dispute informally by contacting us. We'll attempt to resolve the dispute by responding to your inquiry within 14 business days.

8.3 Binding Arbitration

If we are unable to resolve a dispute through informal means, any dispute arising from or relating to these Terms or our Services shall be finally settled by binding arbitration, conducted on a confidential basis, under the applicable commercial arbitration rules of the province in which you reside.

8.5 Class Action Waiver
